Charged in court
Jan 11th, 2008 by Tian
I was already making my way to the airport this morning when I was told by my lawyers that I must come to court immediately.
My bail had been extended twice. The group of us arrested on 11 December had twice came to court, but the police were not prepared. I was told that I had to attend court as the Deputy Public Prosecutor (DPP) would be pressing charges.
This meant I had to forgo my flight to Langkawi at 12:45hr. I was originally scheduled to give a talk for an election training session there. Tonight, I was expected to give a ceramah.
I arrived at the Magistrate Court 2 at about 11. The prosecution was led by Datuk Yusof, a very senior DPP. He presented the charge as “injuring a police officer” while being arrested. No specific description of how the injury was inflicted. I guess the police will persue the “biting” story.
My arrest outside the Parliament while I am in a car. I think that was why they could not charge me for illegal assembly.
The prosecution requested RM5000 bail. My lawyer Ranjit objected and proposed a token of RM500. The judge fixted the bail at RM3000.
It’s still a big sum of money.
I ended up having stayed in the court lockup for 5 hours while waiting for the processing of bail.
I only got out at 16:10hr. Immediately I headed for the airport to catch up my appointment. It is rather annoying for wasting so much time and I had to buy a new ticket.
Our Langkawi crowd will be first to hear my story.
At 16:10hr I was taken out from the ‘dungeon’ to the registration counter for bail
Waiting for the processing of bail, Razak was my bailer
The Youtube video http://www.youtube.com/watch?v=4joFEtOG5nE , during the period approximately 07:10 to 07:20 depicts Tian Chua being beaten by a man in blue with white colar shirt. Tian Chua also shouted JANGAN PUKUL during the period approximately 07:20 to 07:25. Obviously Tian Chua would deny hurting even an ant since he was the one who got beaten. I hope Tian Chua’s lawyer(s) bring these evidence to court.

Tian Chua denies hurting cop
KUALA LUMPUR (Jan 11, 2008): Parti Keadilan Rakyat (PKR) information chief Tian Chua today denied in a magistrate’s court a charge of causing hurt to a policeman outside Parliament House last year.
Tian Chua, whose registered name is Chua Tian Chang, 45, is alleged to have caused hurt to constable Rosyaidi Anuar, 20, of the Kuala Lumpur police narcotics division on the road leading to Parliament House on Jalan Parlimen at 10.45am on Dec 11.
If convicted, he faces a maximum three years jail or a fine, or both, under section 332 of the Penal Code.
Deputy public prosecutor Mohamad Hanafiah Zakaria asked the court to set bail at RM5,000 but defence counsel Ranjit Singh asked for RM500 on the ground that Tian Chua was charged in a sessions court last year with taking part in an illegal assembly and was allowed bail of RM5,000 although it was a non-bailable offence.
Mohamad Hanafiah said that was an alternative charge under the Police Act which carried a maximum RM10,000 fine and one-year jail but today’s charge was more serious and it would not be reasonable to fix bail at RM500.
Magistrate Tasnim Abu Bakar allowed bail of RM3,000 with one surety and fixed April 16 and 17 for hearing.
Bail was raised by Tian Chua’s friend Abdul Razak Ismail.
